1. About these Terms

 

These Terms of Use (“Terms”) govern your access to and use of www.sazerac.com  and any other Sazerac corporate website or microsite that expressly links to or incorporates these Terms (collectively, the “Site”).

 

The Site is operated by Sazerac Company, Inc., a Louisiana corporation and/or its affiliates (“Sazerac,” “we,” “us” or “our”).

 

By accessing or using the Site, you agree to these Terms. If you do not agree to them, please do not use the Site.

 

These Terms apply only to the Site. Sazerac includes, without limitation, businesses operated under the following brand names: Click here to view the brands page.  Separate terms may apply to Sazerac brand websites, e-commerce stores, promotions, loyalty programs, events, experiences and other products or services.  Where separate terms apply to a particular website, activity, or service, those terms will govern the applicable website, activity, or service and will prevail in the event of any conflict with these Terms.

 

 

2. Legal Drinking Age

 

The Site contains information relating to alcoholic beverages.

 

Alcohol related content is intended only for people who are of legal drinking age where they are located.  If you are not of legal drinking age, you should not access alcohol related portions of the Site.

Sazerac’s names, brand names, logos, and other trademarks may not be used without the prior written permission of Sazerac or the relevant rights holder.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

 

 

11. Suspension or Restriction of Access

 

Sazerac may suspend, restrict, or withdraw access to all or part of the Site, including for security, maintenance, operational, or legal reasons, or where we reasonably believe that the Site is being used in breach of these Terms.

 

 

12. Governing Law and Jurisdiction

 

These Terms and your use of the Site are governed by the laws of the Commonwealth of Kentucky, U.S.A., without regard to its conflict of law principles.

 

By using the Site, you agree that the Federal Arbitration Act, applicable federal law, and the laws of the state of Kentucky, without regard to principles of conflict of laws, will govern these Terms and any dispute of any sort that might arise between you and Sazerac.

 

 

The state and federal courts located in Jefferson County, Kentucky, U.S.A. will have exclusive jurisdiction over disputes relating to these Terms or the Site.

 

If you are accessing the Site as a consumer, nothing in this section deprives you of any mandatory rights or protections under the laws of the country or state in which you habitually reside, or of any right to bring proceedings before courts available to you under mandatory applicable law.

 

 

13. Changes to These Terms

 

We may update these Terms from time to time. When we do, we will post the revised Terms on this page and update the “Last Updated” date above.

 

Changes will apply from the date on which the revised Terms are posted or from any later effective date identified by Sazerac.

 

Your continued use of the Site following the effective date of revised Terms constitutes acceptance of those revised Terms, to the extent permitted by applicable law.

If any provision of these Terms is held to be invalid or unenforceable, it will be deemed modified to the minimum extent necessary to make it valid and enforceable or, if that is not possible, deemed severed from these Terms. The remaining provisions will remain in effect.

 

Sazerac’s failure to exercise or enforce any provision of these Terms will not constitute a waiver of that provision or any other provision.

 

These Terms govern only your use of the Site and do not create any partnership, agency, employment or joint venture relationship between you and Sazerac.
